Terms of Service

By commissioning me, you agree to my Terms of Service.

1.) Reservation of Rights: All rights not expressly granted are retained by the artist, including any electronic rights or usage, and including, but not limited to, all rights in sketches, comps or other preliminary materials. Any use additional to that expressly granted above requires arrangement for payment of a separate fee.2.) Work: The artist agrees to produce project materials at the request of the client
for fees agreed upon in advance and delivery of the project by an agreed-upon deadline. The artist agrees that they, themself, will be the sole author of the work, which will be original work and free of plagiarism. The artist will cooperate with the client in editing and otherwise reviewing the work prior to completion and launch.
3.) Original Art: Original art remains the property of the artist unless expressed in the agreement.4.) Revisions and Edits: Revisions may be made only by the artist at the beginning stage of a project. Additional fees will be charged for edits made after three revisions, and for any revisions reflecting a new direction to the assignment, or new conceptual input.5.) Confidentiality: The artist acknowledges that they, themself, may receive or have access to information which relates to the client’s past, present, or future products, vendor lists, creative works, marketing strategies, pending projects/proposals, and other proprietary information. The artist agrees to protect the confidentiality of the client’s proprietary information and all physical forms thereof, whether disclosed to the artist before this agreement is signed or afterward. Unless strict confidentiality is requested by the client in advance of the establishment of this contract, the artist can display materials and final work created for the client on the artist’s website.6.) Compensation and Payment: Client agrees to pay the artist the total project cost after a sketch is approved. If the parameters of the work change, or if it involves more labor than estimated, the artist will inform the client and they can renegotiate the work’s cost. The artist is responsible for the payment of all federal, state, and/or local taxes with respect to the services they, themself, perform for the client as an independent contractor. The client will not treat the artist as an employee for any purpose. Client is expected to pay the entire cost upfront when they deem the project's sketch satisfactory, before the artist works towards completing the commission in full. Failure to pay after a sketch is approved will incur a 3% charge of the project’s total every five days, up until the client pays. By signing for a project, the client acknowledges penalties and late fees that can
increasingly add on to the total cost of the project discussed between the artist and client.
7.) Client Approval: Upon acceptance of the work, the client accepts responsibility for any further processes in which this work is used (e.g. film outpost, printing, etc.) The artist is not responsible for errors occurring in this work or projects related to this work after acceptance of the work by the client.8.) Cancellation: Both parties understand that the client or artist may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. Upon written or verbal cancellation, the client is responsible for payment for all expenses incurred and any work done towards the completion of the project based on the percentage of the project completed that is determined by the artist. Should the client cancel the project following its completion, the client is responsible for full payment as per the agreed upon estimate plus all expenses incurred. In the event of cancellation, the artist retains ownership of all copyrights
and original work created.
9.) Permissions and Releases: The client agrees to indemnify and hold the artist harmless against any and all claims, costs, and expenses, including attorney’s fees, due to materials included in the work at the request of the client for which no copyright permission or privacy release was requested, or for which uses exceed the uses allowed pursuant to a permission or release.10.) Acceptance of Terms: Client promises to pay for the services rendered by the artist for the work as agreed upon. By signing for a project, the client agrees they have read, understood, and are considered legally bonded to these terms.
